Capitalized terms that are not defined in this Privacy Policy have the meaning given them in our Terms and Conditions. 

Personal Information You Provide Directly: 

We may ask for personal information such as your name, email address, phone number and payment information when you register for services, respond to quizzes, download content or if you correspond with us (in which case we may retain your messages to us and our responses). We may also request and retain your resume in connection with providing services to you. 

Personal Information We May Receive From Third Parties: 

We may receive Personal information about you from third parties. For example, if you access our Site through a third-party connection or log-in, for example, by clicking on our digital ads, that third party may pass certain information about your use of its service to us. This information could include, but is not limited to, the user ID associated with your account, an access token necessary to access that service, any information that you have permitted the third party to share with us, and any information you have made public in connection with that service.

You should always review, and if necessary, adjust your privacy settings on third-party websites and services before linking or connecting them to our Site.

We, and our third-party partners, may use cookies and related technologies to collect personal information.  Cookies are small data files that are stored on computers, tablets, mobile phones and any other device used to browse the Internet that allow us and our third-party partners and providers to collect certain information about your interactions with our email communications, websites and other online services.  We and our third-party partners and providers may also use other, related technologies to collect this information, such as web beacons, pixels, embedded scripts, location-identifying technologies and logging technologies (collectively, “cookies”).  We and our third-party partners may use cookies to automatically collect certain types of usage information when you visit or interact with our email communications, websites or other online services.  For example, we may collect log data about your device and its software, such as your IP address, operating system, browser type, date/time of your visit and other similar information. Use of Personal Information: 

We may use the personal information about you that we collect or receive from third-parties to:

  • Provide services to you, including processing payments, making service requests and fulfilling orders; 

  • Send you service-related emails, such as account verification, purchase and billing confirmations and reminders, changes/updates to features of the service, technical and security notices;

  • Provide you news about products and services we or our preferred partners offer and deliver marketing communications and advertisements that we believe you may be interested in;

2. Sharing of Your Information.

Who We May Share Your Personal Information With: 

We may share your personal information with third-party business partners for the purpose of providing services to you.  These business partners may include email providers, server or fulfillment providers, payment processors, data analytics providers, marketing partners (including advertising networks and social media networks) and other service providers that may perform certain functions on our behalf. Instances Where We Are Required to Share Your Personal Information: 

We will disclose personal information where required to do so by law or subpoena or if we reasonably believe that such action is necessary to (a) comply with the law and the reasonable requests of law enforcement; (b) to enforce our Terms and Conditions; and/or (c) to exercise or protect the rights, property, or personal safety of us or others. We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data with third parties.

3. How We Store and Protect Your Information.

Storage and Processing: 

Personal information collected through the Service will be stored and processed in the United States. EB Sanders, LLC may transfer information that we collect about you, including personal information, to affiliated entities, or to other third parties across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to the transfer of information to the U.S. or any other country in which our service providers maintain facilities and the use and disclosure of information about you, including Personal information, as described in this Privacy Policy.

Keeping Your Information Safe: 

We care about the security of your information, and use commercially reasonable safeguards to preserve the integrity and security of all information collected through the Site or the provision of services. However, we cannot ensure or warrant the security of any information you transmit to us or guarantee that information provided may not be accessed, disclosed, altered, or destroyed. We are not responsible for the functionality or security measures of any third party. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

 

4. Your Choices About Your Information.

Opting Out of Collection of Personal information: 

You may, of course, decline to submit any personal information through the Site, in which case we may not be able to provide certain services to you.

Modifying Your Account Information and Settings: 

You may update your account information and email communication preferences at any time by sending an email to ebs@ebsanders.com. 

Changing Methods of Communication:

In connection with our Services, we may need to send you email messages or other communications regarding our services.  You may ask us not to send you marketing or promotional communications by clicking on the “unsubscribe link” provided in such communications or by sending a request to ebs@ebsanders.com.  We make every effort to promptly process all opt-out requests.  If you request to opt-out of marketing communications, please note that you may not opt-out of service-related communications, such as account verification, purchase and billing confirmations and reminders, changes/updates to features of the Site, technical and security notices and similar notices. 

5. Children’s Privacy.

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to use our services. The Site and its content are not directed at children under the age of 13. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible.

6. Other Web Sites and Services.

Our websites and online services may include links to or redirect you to third-party websites, plug-ins and applications, including social media services where you may connect with us.  Third-party websites may also reference or link to our websites and online services.  We are not responsible for the practices employed by websites or services linked to or from the Site, including the information or content contained therein. Please remember that when you use a link to go from the Site to another website, our Privacy Policy does not apply to third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party’s own rules and policies. In addition, you agree that we are not responsible and we do not exercise control over any third-parties that you authorize to access your information.

Personal Information Rights.  Certain jurisdictions grant individuals rights in relation to the personal information collected and processed about them.  Depending on your state of residency and applicable law, you may be able to request to exercise the following rights in relation to the personal information we maintain about you:

The right to request confirmation regarding whether we process personal information about you and certain details about the personal information we may process.

Access & Portability

The right to request access to and obtain a copy of personal information we maintain about you, including a copy of the data in an easily accessible format that you can transmit to a third party.

Correction

The right to request that we correct or update any personal information about you that is inaccurate or incomplete.

Restriction of Processing

The right to request that we limit the purposes for which we process your personal information, including to restrict our ability to sell your personal information, conduct cross-context behavioral advertising, or continue to process your personal information if such continued processing is not justified, such as where the accuracy of the personal information is contested by you.

Objection to Processing

The right to object to our processing of your personal information, such as where we are processing your personal information for marketing purposes or where you believe there is no compelling and legitimate interest for the processing.

Deletion

The right to request the deletion or erasure of personal information about you. Please note we may need to close your account with us in order to fully delete your personal information.

Non-Retaliation

The right not to receive retaliatory or discriminatory treatment for exercising any of the rights described above.

Withdrawal of Consent. Where we rely on your consent for processing of your personal information, you may be able to withdraw your consent to such processing, subject to certain limitations at law.
